Category 2

This offense is prosecuted under Article 134 of the UCMJ (10 U.S.C. § 934), the General Article. It punishes indecent conduct — behavior of a sexually immoral nature that is grossly vulgar, obscene, and repugnant to common propriety, done under circumstances prejudicial to good order and discipline or discrediting to the armed forces.

Disambiguation — this is not Article 134 itself

Article 134 is a general clause under which the Manual for Courts-Martial lists numerous separately defined offenses. Indecent conduct is one of those enumerated offenses, distinct from indecent exposure under Article 120c, which specifically requires exposing certain body parts.

Who It Applies To

Any person subject to the UCMJ who engages in indecent conduct, under circumstances prejudicial to good order and discipline, or discrediting to the armed forces.

What It Covers

  1. The accused engaged in certain conduct.
  2. The conduct was indecent.
  3. Under the circumstances, the accused’s conduct was prejudicial to good order and discipline in the armed forces, was of a nature to bring discredit upon the armed forces, or both.

Key rules

  • Indecent means that form of immorality relating to sexual impurity which is grossly vulgar, obscene, and repugnant to common propriety, and tends to excite sexual desire or deprave morals with respect to sexual relations.
  • The offense includes conduct previously charged as “indecent acts with another,” except that the presence of another person is no longer required. “Conduct” and “act” are synonymous here.
  • For offenses involving children, some indecent conduct falls within the definition of a lewd act and is preempted by Article 120b(c).

Maximum Punishment

Maximum authorized punishment. Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 5 years.

Sentencing parameters. Category 2 (1–36 months).

The newer sentencing rules apply, subject to the capital-case rules, when the accused is convicted only of offenses committed after 27 December 2023. See How UCMJ Sentencing Rules Apply. The maximum authorized punishment and the applicable sentencing framework do not predict the sentence in a particular case.

Indecent conduct is one of the offenses listed under the General Article. Intentional indecent exposure of specified body parts is addressed by Article 120c, lewd acts involving a child by Article 120b, and indecent language by the separate Article 134 offense.

What the Provision Does

This offense addresses a residual category of grossly indecent sexual conduct that does not fit the more specific definitions of the enumerated sexual offenses under Articles 120, 120b, and 120c, while still meeting the general article’s terminal element.

History

Indecent conduct was an enumerated Article 134 offense in the 2016 edition of the Manual for Courts-Martial (paragraph 90). The 2018 amendments to the Manual (Executive Order 13825), effective January 1, 2019, carried it forward as the current paragraph 104.
